Daniel is an English solicitor and Partner of Clyde with over 15 years’ experience of working in the superyacht sector.
In acting for the owners of superyachts, Daniel regularly drafts and advises on newbuilding contracts for motor and sailing yachts. New building contracts include those for bespoke vessels and production boats, and have included vessels with a length overall of more than 100m. He has a large amount of experience in dealing with Ultimate Beneficial Owners, Owners’ representatives, project managers, newbuilding supervisors and Captains in accompanying and advising on all aspects of new building and refit projects.
Daniel also acts in the sale and purchase of second hand superyachts, including on the basis of the MYBA standard form documents.
In relation to litigation and claims, Daniel and his team of English solicitors in the Hamburg office represent superyacht clients in London maritime arbitration and Commercial Court proceedings. Litigation in the superyacht sector includes disputes in relation to painting/coating, liquidated damages for delay, disputes over quality, and insurance claims.
The Hamburg English team led by Daniel advise Owners, technical managers and insurers on insurance matters and claims in relation to superyachts, including in relation to casualties where the team has experience of dealing with salvage and towage contracts, pollution and claims where a constructive total loss (CTL) of the vessel is alleged. Daniel also acts for Owners and their insurers in claims and investigations involving crew injury and death. Daniel acts for Hull & Machinery Underwriters of superyachts, in advising on and defending claims for CTL, partial loss and theft/misappropriation.
Having earlier practised in the London market and since 2008 in Hamburg, Daniel has knowledge of both the German and London markets.
